TERMS & CONDITIONS

Conditions

“African Cruising Tours” (hereinafter referred to as ACT) reserves the right to cancel or change any tour in accordance with operating requirements or circumstances. If unforeseen circumstances beyond our control make changes necessary, we reserve the right to alter itineraries, travel routes, hotels and restaurants as required. Should cancellation or change be necessary, ACT will offer you the choice of alternative tour dates or a full refund. ACT is not responsible for any other travel arrangements affected by our cancellation or changes.
Under no circumstances shall ACT be held responsible for rain, wind, snow or other weather conditions, nor can your tour participation be cancelled or amended by you on the basis of rain, wind snow or other weather conditions.

Equipment Problems

  • Our bikes are well-maintained, late model Harley-Davidsons. Mechanical breakdowns are rare. If a motorcycle becomes inoperable due to mechanical failure and the problem cannot be reasonable resolved, a replacement motorcycle will be provided.
  • If a motorcycle becomes inoperable for any reason other than mechanical failure, it will not be replaced.
  • ACT provides a high quality lock for each motorcycle that must be used at all times when the motorcycle is unattended. A stolen motorcycle will not be replaced.
  • ACT will not be liable for missed reservations or other expenses incurred as a result of any motorcycle breakdown or loss.

Responsibilities

It is the responsibility of ACT to properly arrange and conduct your tour per the tour descriptions contained herein. However, ACT and its owners and agents shall not be responsible for, nor shall they accept liability for any claims, damages, losses, costs or expenses arising from:

  1. Personal injury, disease, sickness, or death, however caused, while engaged on or by reason of your participation on any ACT tour, whether due to maintenance, use, operation or control of any motorcycle, automobile, hotel, airline or other common carrier used in conjunction with the tour;
  2. Loss or damage to luggage or other property. We strongly recommend you purchase travel insurance covering loss, damage or theft of luggage and personal belongings;
  3. Delay, failure or loss resulting during a ACT tour due to the actions of hotel operators, airlines and other common carriers, other suppliers, or due to government action, mechanical breakdown, weather, labour dispute, terrorism, acts of war, acts of God, or any other causes beyond ACT's direct control.

WAIVER & RELEASE AGREEMENT

EACH TOUR PARTICIPANT MUST AGREE TO AND SIGN THE FOLLOWING WAIVER AND RELEASE:

My payment of a deposit constitutes my understanding and acceptance of the information, terms and conditions herein. I further understand and accept that the Road-King Touring Company of SA (ACT) tour and related activities involve risk of personal injury or death and damage to, or loss of property. In consideration of the benefits to be derived, I hereby accept all risks of personal injury and property arising from my participation in this ACT tour and I hereby agree that I, my dependents, heirs, executors and assigns do realise and hold harmless ACT and its owners, employees and agents from any and all claims, including claims of death, bodily injury, illness, property damage or loss, however caused, arising from or related to this ACT tour.
Further, by payment of a deposit and/or my signature on this form, I certify that I do not have any physical condition, mental condition or other disability that would create a hazard for me or other tour participants. I also certify that I am over 21 years of age and that I am in possession of a currently valid motorcycle operator's license issued in my country of residence. I accept that the onus rests on me to ascertain validity of said licence in the Republic of South Africa.
I have carefully read the tour descriptions, Terms and Conditions and this Waiver and Release Agreement, and will abide by everything as stated herein or elsewhere published by ACT. Furthermore, I affirm that I have not received or relied on any oral or written representation of ACT as a basis for executing this Waiver and Release.

Payment Policy
A deposit of 50 percent per person of the tour cost is required to reserve space on a tour. Payment must be received within 10 days of receipt of your reservation form. The balance is due no later than 45 days prior to the tour. ACT has the right to cancel your reservation and apply cancellation charges as indicated below if payments are not received as specified.

Cancellation & Refund Policy

  • An administrative fee of 25 percent of the deposit will be assessed for cancellations made more than 90 days prior to the tour.
  • 50 percent of the deposit will be assessed for cancellations between 45 and 90 days prior to the tour.
  • The full deposit amount will be assessed for cancellations between 30 and 45 days prior to the tour.
  • 100 percent of the tour cost will be assessed for cancellations made less than 30 days prior to the tour.
  • There will be no refunds for unused services or accommodation once the tour has started.
  • If you believe your trip is at risk for any reason, we recommend that you purchase trip cancellation insurance.

Safety
South African law requires that a safety helmet be worn while operating or riding on a motorcycle. ACT prohibits tour participants from consuming alcohol or taking mind altering drugs while operating or riding on any of our motorcycles. Anyone found to have consumed alcohol or drugs prior to or during any day's ride may be prohibited from riding for the remainder of the tour. ACT reserves the right to decline, accept or retain any tour participant at any time.

Sun Burn
African sun, even during winter from (May to July) is harsh. The greatest risk of serious sunburn is during the period of 10:00 - 14:00. Sun block cream and sunglasses are necessary requirements if you want to enjoy your trip. Aside from the long term risks of skin cancer, sunburn could affect your comfort levels while riding.

Insurances
Collision damage waiver and theft protection insurance are included in the price. Please note! A deposit of Rand 10,000 is required at the time you collect the motorcycle. The deposit to be paid by credit card authorization on departure of rental, and withheld until the motorcycle is cleaned and inspected upon return, at which point the deposit shall be returned if no damage is found. The deposit is reduced to Rand 7,500 should you hire the bikes without panniers.

Miscellaneous travel expenses
Entry fees into parks as mentioned in the tour description are covered in the price.

Maps
We will provide you with a map of South Africa at the beginning of the tour.

Luggage transport
We generally have a vehicle that accompanies us on these trips, in which your luggage is transported. We will gladly transport one piece of luggage per person, collecting it before your departure and delivering it to your hotel or guestroom on arrival. Pillions can also gladly travel in the vehicle for the more difficult stretches or on request as well.

Tour guide
A bilingual English/Portuguese speaking tour-guide will lead every tour. All our tour-guides are registered with the relevant tour guiding authorities as well as associations, and have had comprehensive training. Our tour-guides also possess an excellent general knowledge of South Africa and have done in-depth research on the routes and sites that they will be taking you on.
